The U.S. Justice Department filed suit against the State of Arizona Tuesday, challenging the constitutionality of the recently passed illegal immigrant law.

The U.S. Justice Department filed a lawsuit Tuesday, July 5, 2010 challenging the constitutionality of Arizona's new illegal immigrant law. This lawsuit sets the stage for a showdown between the federal government and Arizona over the toughest immigration law in the country.

The Lawsuit and the Legal and Constitutional Issues

The lawsuit was filed in U.S. District Court in Phoenix and argues that Arizona's law that requires state and local police to question and possibly arrest illegal immigrants during the enforcement of other laws usurps federal authority and is therefore unconstitutional.

In terms of a legal basis for the lawsuit, the feds contend that the Arizona law violates the supremacy clause of the Constitution, pre-emption being well-founded legal theory that federal laws override state laws.

The lawsuit initially seeks an injunction to delay the July 29, 2010 implementation of the law until the case has been fully resolved in court.. Beyond that, the government is also requesting that the law be declared invalid.

Reaction in Support of and Against Arizona SB-1070

Arizona State Sen. Russell Pearce, a main sponsor of the bill that was co-sponsored by dozens of Republican legislators, stridently claimed the lawsuit was an "absolute insult to the rule of law" as well as to Arizona and its residents.

"It's outrageous and it's clear they don't want (immigration) laws enforced. What they want is to continue their non-enforcement policy," Pearce said in a July 6, 2010 Associated Press article "Feds sue to block Arizona illegal immigrant law "."They ignore the damage to America, the cost to our citizens, the deaths" tied to border-related violence," Pearce continued.

State Rep. Kyrsten Sinema, a Phoenix Democrat who voted against the law, said the lawsuit will help settle questions over what states can do when they don't think federal laws are being adequately enforced.

"I hope this galvanizes Congress to gain the moral courage they need to address this (immigration) crisis," Sinema said in the July 6, 2010 article.

There have been many protests against the new Arizona illegal immigrant law all across the nation and even internationally. The President of Mexico, Felipe Calderón, has attacked the legislation on a number of occasions. pointing out the contribution Mexicans have long made to Arizona's economy and the unfairness of the law.

The filing of a lawsuit by the federal government in this matter has been expected ever since Arizona Governor Jan Brewer signed the legislation into law. President Obama has called the state law "misguided", while those who favor it say it is a reasonable reaction to the federal refusal to take action in regard to immigration issues.

THIS IS POLITICS AT IT'S WORST!!
Infact arizona should be sueing the us government for all of their lost revenues due to their inaction enforcing the law. Arizona should not have to be doing this, they are having to do the job of the us government!!!
ALL THEY HAVE TO DO IS INFORCE THE FEDERAL LAWS ON IMMIGRATION....THIS IS NOT A MATTER OF OPINION IT IS THE LAW....AND IT'S THE GOVERNMENTS JOB TO ENFORCE THESE LAWS!!!! THEY ALL NEED TO GET A BRAIN INCLUDING OBAMA!!!
I think that all of these people who are against these laws should go and live in arizona and see how they like living in a lawless state. My heart goes out to the residents of this state.

I have been an AZ resident for 11 years...and I am so glad the Justice Dept finally made a move on SB1070. The law is an outright disgrace - and being an AZ resident - I was ashamed when Brewer signed it into law. Border security and immigration reform should be a top priority in DC. It is unfortunate that our reps in DC use this issue for poticial points instead of actually dealing with it. For years different presidents have tried to reform immigration - and every single time the bill has been killed in Congress (GW tried twice and his own party killed it). It's time to stop playing the blame game in DC and get down to business for the good of the country. I would be all for SB1070 if it accomplished anything. It doesn't address the border, it doesn't stop illegal immigration, and could violate American citizens civil rights. Furthermore, it gives local & state police power to detain anyone they want under "reasonable suspicion". You can be reported by friends, neighbors, or family members for "harboring" illegal aliens, if an illegal alien rides in your car, if you rent to one or if they work in your place of business. SB1070 goes too far - and threatens the very fabric of American society. When I moved to AZ - I wasn't anticipating living in a police state. I hope this horrible law is overturned soon!

Well, according to the original organic constitution - the power is this way; Soverighns, have supreme power ( we fought the civil war to become soverighns) we are not so "soverighn" anymore, and states have the second highest power, with the feds being the third power, of course we, are not told much about the orgaic constitution, so most of us wrongfully beleive the feds have all the power, I am so glad that our states are taking the power they deserve, even if you don't agree with the laws, you now can simply move to a different state, instead of leaveing the us altogather!
